Legally speaking, collection agencies cannot re-age your debts. What they can technically do is report the debt as becoming delinquent on the date it was referred to the collection agency in an effort to extend the time during which the debt can be reported on a consumer’s credit report. This is how debts are re-aged, which is actually in violation of both the Fair Debt Collection Practices Act (FDCPA) and the Fair Credit Reporting Act (FCRA). According to the FCRA, a debt can be reported for 7 years from the date of the original delinquency. A furnisher of information must report the first date of delinquency, or be be fined with $2,500 should he change the date of the original delinquency. The FDCPA also prohibits making false or misleading representations in connection with the collection of a debt.
Should your credit report shows a re-aged account, write to the credit bureau and dispute the tradeline and request that it be deleted from your report. Say why the debt shouldn’t be reported, including the original creditor and the original date of delinquency, and back these reasons with proper documentation showing the original date of delinquency. Also write the collection agency about the dispute, and request that they provide you with the underlying documentation which supports the debt, and which shows the original date of delinquency. If they wouldn't do so, you may need the help of your state’s Attorney General’s Office and/or the Better Business Bureau. Consult your attorney if you can sue the collection agency for its violation of federal laws.

Is there a way to stop a debt collector from calling you? I know, those calls are so annoying, they even wake you up in the middle of the night. But good thing there is a way. Your right as a debtor is still protected by law under the Fair Debt Collection Practices Act. The Act requires a debt collector or a collection agent to treat you fairly when collecting your debts. You can stop a debt collector from calling you by sending a letter requesting him to stop phoning you. Actually, there are some collection practices that a debt collector should not do to you.
A debt collector can't harass or abuse you or any member of your family with his calls. He should not threaten you with jail or any violence because of your debts. He can no longer call you about your debts if he has received your letter stating your demand not to call you again. Also, he should not use any profane or obscene language. Also, a debt collector should not make a false title like he's a lawyer or a credit bureau's officer. However, even if there are restrictions on collection methods, as a debtor, you are responsible to pay your debts on the specific time that you know you can pay.

Technology may have been a gift for some, but for those deep in huge debts and those experiencing other kinds of financial crisis, the available ways of communication that we have nowadays can be curse. How so? Well, let's take the case of my cousin. A collection agent calls him on his home phone, office phone, and heck, even mobile phone! That's how advanced and at the same time, sneaky credit card companies can be when they're after your money. But wait, when do they not want your money, anyway?
What most of us don't realize is the solution to these annoying calls is simple. Write the collector a letter that states that you do not want them to contact you. I helped my cousin compose a letter and made sure that they receive it. It worked. But of course, it did not erase the debt he has accumulated and the next correspondence he received was a notification for a possible legal action. That scared the hell out of the dude and he was able to manage money savings to pay whatever he owes the collector. So, whatever debt you have, whether in house mortgage, car loan payments, or other kinds, don't make it reach the point of frequent calls from your creditor.

You are called a debtor when you are using credit cards, have to pay some money to a person, or a company, or pay monthly dues on your home mortgage loan. Whatever the case may be, you are supposed to be accorded fair treatment in so far as the collection of debt is concerned. As such, your creditors and their debt collectors or agents should follow accordingly the stipulations in Fair Debt Collection Practices Act.
The money which you loaned and put into your financial investment should be paid based on the agreements between you and the creditor. But bear in mind that a collector cannot make use of violence, coercion, or harm. The collecting agency cannot publish or make known a printed list of debtors anywhere except in the credit bureau. Likewise, collectors cannot use profane or obscene words personally or over the telephone.
In addition, collecting agents should not use statements that are misleading such as implying they are lawyers or representatives from the government. In the same manner, they cannot tell that papers given to you as lawful or legal when such papers are illegal and vice versa. They cannot also say that you are to be charged or arrested when you cannot settle your debt. Still, there are a lot of stipulations in this Act when it comes to fair practice on collecting debt. You should acquaint yourself with these information so that you won't be fooled whenever you engage in debt transactions.

When an individual has debt from way, way back, he often forgets it. One day he'll be surprised that a credit collector comes knocking at his door asking for the payment of the debt. Because he is not sure of the existence of the debt and because the collector is hard-pressed to obtain payment, the poor fellow may just give in.
The best thing to do when a collection agency starts collecting your dues is to validate them. This process is called debt validation. This is your only weapon to assure that the debt collector has a right to collect the debt and to determine whether you should pay it or not.
As a consumer you have to know whether there is validity on the debt being collected from you. This is your right which is covered by a law known as the Fair Debt Collection Practices Act. According to the law, a debt collector needs to inform the debtor beforehand through a written notice within the first 5 days when the collector communicated with the consumer. The written notice should specify the amount of the debt and the name of the creditor among other things. So before paying a certain debt, ask for its validation. It’s your right.

It is common knowledge that lenders hire the services of debt collection agencies to ask the borrower's monthly payment. This job, which really brave people take, is most of the time the butt of jokes. We cannot blame the debt collectors, actually. The lenders are just very cunning when they thought about hiring a collection agency instead of them being hassled with this task. In truth, debt collectors are very polite although some of them ruin the reputation of other debt collectors.
Anyway, you can't blame them, can you? I mean, you have to have the guts of steel to still try to take money from a home that already can't pay the electric and water bills with kids getting hungry. Okay, this might be exaggerated but at least you will get the idea of how hard it is to collect debts. So next time, a collector knocks at your door, be polite. If you can't pay, just say. No need to lash out and take your anger at them. Any which way you look at it, they're just doing their job. Do yours and pay faithfully.

Creditors hire debt collection agencies to collect their payments for them. There have been naughty jokes running around about debt collectors. They are sometimes being compared to tax collectors in the Viking era.
Tax collectors at that time had the option to behead you or put you in a dungeon if you can't pay. This is a harsh comparison actually. Most debt collectors are kind and have good interpersonal skills. They are usually considerate if your reasons are valid. The jokes may continue and so will the debt collection.

Believe it or not, but the creditors are not the devil. They are not brought to existence to harass or stress you out. They are just people who are doing their jobs. If you want to maintain a good relationship with your creditor, you should always pay your bills on time. However, there may come a time when you miss some payment dates.
If this happens to you, there is always a way to fix this. First of all, you can talk to your creditors and ask for a payment extension or something. Surely, they will understand your situation and grant your request. But when you promise something to them, make sure that you follow it.
